Most people picture a lawsuit as a dramatic trial. In reality, the trial is the last act, and most cases never reach it. Understanding the steps in between tells you where a case is actually won.
Pleadings
A suit begins with a petition stating the claims, followed by an answer. The answer is what stops a default; filing one, on time, keeps you in the fight.
Discovery
Then comes discovery — the exchange of documents, written questions, and depositions. This is the long middle of a case and, more often than not, where it is decided.
Motions and trial
Dispositive motions can end a case before trial. If the case survives, it goes to a jury or a judge. A party that prepared as if trial were inevitable holds the leverage at every earlier stage.
