What Discovery Really Is

T. Maxwell Smith· February 3, 2026· 1 min read

Depositions, document requests, and interrogatories are not paperwork. They are how a case gets built.

Discovery is the formal exchange of evidence before trial. Done well, it wins cases. Done lazily, it loses them.

A deposition locks a witness into a story. A document request can surface the email that decides everything. We treat discovery as the main event it usually is.
