Standard of Review
Definition
The level of deference an appellate court gives a trial court's decision. Some rulings are reviewed fresh; others stand unless the trial judge clearly abused discretion.
Hypothetical
A party appeals a discovery ruling. Because that decision is reviewed for abuse of discretion, the appeals court will not reverse merely because it might have ruled differently.
