Preserving Error
Definition
Making a timely, specific objection or request at trial so that, if the judge rules wrongly, the issue can be raised on appeal. An error not preserved is usually waived.
Hypothetical
Damaging hearsay is offered and the lawyer says nothing. Because she failed to object and preserve error, the appellate court will not consider whether admitting it was wrong.
