No-Evidence Motion
Definition
A Texas motion for summary judgment arguing that, after adequate time for discovery, the other side has no evidence on one or more essential elements of its claim. It forces the claimant to produce proof or lose.
Hypothetical
A plaintiff alleges fraud but, after a year of discovery, has produced nothing showing the defendant made a false statement. The defendant files a no-evidence motion; the plaintiff cannot point to any proof of falsity, so the claim is dismissed.
